36. Trial Motions, Appeals, and Filing Production

36.1 Start with the receiving-requirements worksheet

Record the court, case, document type, governing national or statewide rules, local rules, standing orders, judge-specific instructions, page or word constraints, record system, and citation requirements. Save each controlling source and its effective date. Recheck shortly before filing because the relevant version can change while a brief is being drafted.

36.2 Separate facts, standards, and application

A factual assertion needs an accurate record reference. A legal standard needs appropriate authority. Application explains how the standard bears on the facts. Keep those functions visible. A citation to a legal case does not prove a fact about the present record, and a record citation does not establish the governing standard of review.

36.3 Build the table of authorities from the final document

The table should help readers find where an authority appears. Rebuild it after substantive edits and pagination changes. Resolve duplicate identities, inconsistent short names, and mistakenly indexed quotations. Check several entries against the exported PDF, including authorities used only in footnotes.

36.4 Check the appendix independently

The appendix is a document with its own assembly risks. Confirm item identity, completeness, page labels, redactions, legibility, bookmarks, and consistency with citations. An item omitted during assembly remains missing even if every reference in the brief was correct before assembly. The final exported appendix, not the source folder, is the object the reader receives.

36.5 Freeze a reviewable release

Assign a final filename or version and retain a review record identifying what was checked. If a last-minute edit changes quoted text, citations, tables, or pagination, repeat the affected checks. Do not carry forward an “approved” label from a materially different artifact. After filing, retain the accepted document and receipt according to the matter's authorized records practice.

Exit test. Open the delivered files on a separate viewer. Follow a sample of hyperlinks, jump to record references, inspect the table of authorities, and search for unresolved working labels. A successful word-processor export alone does not establish a usable filing.
